I'm no lawyer and I don't play one on TV but I've never had the patience to wait for these things to be legitamized. I would simply go ahead with your plans and if they don't like it, they'll let you know.
Once you get that first "cease and desist" letter by certified mail, they arn't quite so scary anymore.
Look at it this way, if it did turn into a federal case between Discovery and you, the notariety would certainly peak the interest of others in the fitness field that would SEEK YOU OUT to do a show with their workout programs.
